Guardianship Administration and Litigation

BNS often represents clients dealing with situations relating to an incapacitated or developmentally-disabled adult. These situations often need the help and support of a loved one or a third-party guardian. Often these situations require establishing a legal guardianship. Guardianship is the process whereby the Courts of Texas intervene to help those that cannot help themselves and appoint a person to be responsible for protecting them from unscrupulous individuals that might exploit or take advantage of them. The need to apply for guardianship of a family or friend can be one of life's most difficult experiences, both for the intended guardian and the individual over whom guardianship is sought. BNS attorneys have extensive experience representing individuals that either have a family member that require a guardian or as serving as a guardian for an incapacitated person.

BNS attorneys are experienced in assisting in establishing guardianships for elderly parents, a special needs child or a sibling in need of a guardian. The establishment of a guardianship is not a process to be undertaken lightly but is often required in situations where a friend, relative or loved one is at risk of being exploited by someone that preys on individuals with impaired decision-making abilities. Guardianship is often desirable when there are disagreements within a family about the needs of a family member and issues or disagreements as to how to handle an elderly or challenged person's affairs. Every guardianship has its own nuances based upon the specific circumstances. The attorneys at BNS are prepared to provide sound legal advice and assistance in the establishment of guardianships as well as acting as guardians when warranted.

BNS is experienced in handling guardianships and the firm's staffs are sympathetic to the sensitivity of the situation. The firm approaches guardianship with a great deal of respect for the dignity of the family members and we act quickly to establish the legal and support framework required to protect the individual. BNS believes that it is important that everyone involved understand the legal process of a guardianship and duties and responsibilities that exist as a result of the guardianship relationship.

The firm also represents individuals who may, for valid reasons, wish to contest the appointment of a particular guardian or desire to litigate over whom is most qualified to serve as guardian–often representing a family member, or other, who is under the belief that an appointed guardian has done something inappropriate, mishandled funds, or has taken advantage of the person they were appointed to protect. Our attorneys are experienced in handling these issues and able to assist you in these types of contested matters. Contact Keith Morris to make sure your loved one is protected.
