Insolvency / Bankruptcy Litigation

BNS is well qualified to handle all aspects of consumer bankruptcy, business bankruptcy and other out-of-court forms of financial reorganization. While many issues in bankruptcy cases can be resolved by consensus, bankruptcy often involves substantial litigation to protect the rights and interests of its participants.

BNS's bankruptcy attorneys have represented parties both in contested matters and in adversary proceedings in the bankruptcy courts. They have litigated bankruptcy-related matters at in the federal system from the bankruptcy courts to the circuit courts and through various level of state courts in which its attorneys are licensed or were admitted to appear pro hoc vice. These bankruptcy attorneys have represented parties on all sides in a variety of contested matters and are therefore uniquely qualified to see "all sides" of the issues presented to them.

BNS's bankruptcy attorneys also have extensive knowledge of prosecuting and defending claims in adversary proceedings and considerable experience in representing trustees and liquidating/plan agents who have wanted to bring bankruptcy and state law causes of action. As a result of having represented bankruptcy estates in bringing such claims, BNS is able to more effectively represent parties in the defense of such claims.

BNS has represented creditors in lawsuits to deem certain debts non-dischargeable, to object to a debtor's discharge, and to seek revocation of a debtor's discharge. BNS also has substantial experience representing debt-collectors in the defense of lawsuits for automatic stay and discharge injunction violations.
